Terms And Conditions Of Bike Rental

When registering as a Member to the citybyke hire scheme you will be presented with the following which you will need to approve prior to final registration.

I recognize the dangers inherent with bicycle riding. I am assuming the hazards of this risk upon myself since I wish to ride. I realize that I am subject to injury from this activity and that no form of preplanning can remove all the dangers that I am exposing myself to. I understand that it is beneficial to wear a helmet but this decision is mine.

I understand that citybyke does not provide me with any insurance for the use of the citybyke scheme

I assume liability for any and all property damages or personal injuries, including my own, or anyone else arising out of the operation of the bicycle and equipment rented. I will be responsible for any monetary charges for extra rental time, stolen equipment, or damages noticed after rental, such as but not limited to, bent rims; bent pedals; broken spokes, flat tires, etc. at the time of the return. Failure to return the above rented equipment is a serious crime and violators will be prosecuted for theft.

Prior to riding a citybyke bike I confirm that I shall check the bike to ensure that it is operable and fit for riding. I will check the brakes, lights both front and back and will ensure that the bike is returned in the same condition to that which it was removed from the docking station. Any damage to the bike shall be notified at a kiosk immediately on return of the bike to the docking station. A further check on the condition of the bike shall be undertaken by me within 10 metres of the docking station to ensure that all components are working correctly and safely. If they are not I shall return the bike (by walking and pushing the bike) immediately to the docking station.

Citybyke do not offer any warranty of merchantability or fitness for a particular purpose and I agree to utilise the bike "as is".

I agree to check the condition of the bike whilst being used to ensure that it is safe to ride, if it is not then I agree to walk it back to the nearest kiosk.

If during usage the bike becomes unsafe to ride then I shall return it immediately to the nearest docking station (by walking and pushing the bike) and report the fault at the kiosk.

I agree to not overfill the front basket so that it effects the handling of the bike and neither shall I obscure the front or rear light.

I agree to not use the bike for onward rental or for participation in any race, event or other. Nor shall it be used in any violation of law, ordinance or regulation. I agree that I am familiar with the laws, rules, and regulations pertaining to the use, riding and/or operation of the bike. Any fines payable as a result of my unlawful (or other) acts shall be met by me and I shall in no way hold citybyke liable.

The bike shall only be used in appropriate locations and shall not be ridden through water or any unsuitable terrain.

I agree to not carry excessive loads in the carrier / basket provided and neither shall I carry a passenger on the bike in any way or allow a third party to ride the bike at any time. I shall not push or pull any item or person whilst using the bike.

I agree to not remove the bike from its country of origin.

I agree to not use the bike under the influence of alcohol or drugs.

I am 18 years of age or older. Any minor aged 14 or over may only use the scheme with the authorisation of their legal guardian

If the bike is stolen or damaged I shall inform citybyke on 01273 66 88 98 immediately.

I confirm that I am capable of riding the citybyke bike and understand the risks associated with such usage.

The rates payable are as follows -

Daily - from £2.00 per day for day of rental
Weekly - from £7.00 per week for week of rental
Annual - from £50.00 per annum

The first one hours usage is free thereafter the charge is £3.00 per hour or part thereof. If the bike is not returned then I acknowledge that I shall be liable for a minimum charge of £150.00 GBP which shall be deducted from my credit / debit card or (in the case of annual members) by way of direct debit.

Please note that these are indicative prices and may vary at different cities. A deposit will be required to secure the value of the bikes. I acknowledge that these rates may be subject to change.

Citybyke its officers and agents do not guarantee the supply of a bike once you have become a member.

I acknowledge that citybyke can terminate my membership if I am in breach of these Terms and Conditions.

I hereby release Unity Transport Ltd trading as citybyke and their respective affiliates, subsidiaries, offices, directors, employees, and agents ("Releasees") from any and all claims, actions, damages, costs, and expenses, including lawyers fees, as a result of arising from my participation in the rental of the citybyke bike, including, but not limited to, personal injury, property damage or wrongful death. THIS INCLUDES, WITHOUT LIMITATION, ANY CLAIMS, DAMAGES OR ACTIONS ARISING OR RESULTING FROM THE ORDINARY NEGLIGENCE OF RELEASEES. I hereby agree to waive any and all such claims and declare that this Waiver and Release is to be binding upon my heirs, executors, administrators and assigns. Further, I hereby agree to release and discharge the Releases from any loss or theft of, or damage to, personal property.

I FULLY UNDERSTAND THAT I FOREVER GIVE UP ANY RIGHTS TO SUE OR MAKE A CLAIM AGAINST THE RELEASEES IF MY FAMILY OR I SUFFER INJURY OR DAMAGE EVEN THOUGH I (WE) DO NOT KNOW WHAT OR HOW EXTENSIVE THE INJURY OR DAMAGE MAY BE. I HEREBY PERSONALLY ASSUME ALL RISKS WHETHER FORESEEN OR UNFORSEEN IN CONNECTION WITH THE ACTIVITY OR ANY ACTIVIES INCIDENTAL THERETO. I FULLY UNDERSTAND AND AGREE THAT THESE TERMS ARE CONTRACTUAL AND NOT A MERE RECITIATION AND THAT I HAVE VOLUNTARILY APPROVED THIS DOCUMENT BY CLICKING THE "I AGREE" BUTTON AT THE BOTTOM OF THESE TERMS AND CONDITIONS.
